SB 65, sponsored by Senator Benson, requires all “retail service station dealers” to maintain at least one operational video camera, record the activity, and retain the activity.
(A) (1) EACH RETAIL SERVICE STATION DEALER SHALL:
(I) MAINTAIN AT LEAST ONE OPERATIONAL VIDEO CAMERA ON THE EXTERIOR PREMISES OF THE SERVICE STATION FOR THE PURPOSE OF RECORDING ILLEGAL ACTIVITY; AND
(II) PRESERVE THE RECORDINGS MADE BY THE VIDEO CAMERA FOR AT LEAST 45 CALENDAR DAYS.
(2) A VIDEO CAMERA REQUIRED UNDER THIS SUBSECTION SHALL BE CAPABLE OF RECORDING AN IMAGE OF AN INDIVIDUAL THAT IS OF SUFFICIENT QUALITY TO ENABLE IDENTIFICATION OF THE INDIVIDUAL FOR THE PURPOSE OF INVESTIGATING OR PROSECUTING SUSPECTED ILLEGAL ACTIVITY.
(B) A RETAIL SERVICE STATION DEALER WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $500.
This is a gross overreach by government – at least the proposition of this bill is. The state is requiring private business to surveil the area and keep the cameras’ recordings, ostensibly to be available to the state when they ask.
